1. Scope of Services

LBTA LLC provides professional legal translation and related language services as agreed in writing with the client. The scope, language pair, deadline, format, fee, and any special instructions are determined by the accepted quote, estimate, email confirmation, or project agreement.

A project begins when LBTA LLC issues a quote, estimate, or written project confirmation and the client accepts it by email, written approval, payment, or instruction to proceed.

2. Client Materials and Instructions

The client is responsible for providing complete and accurate source documents, reference materials, terminology, prior versions, formatting instructions, and any information relevant to the intended use of the work.

The client confirms that it has the right to provide the source materials to LBTA LLC for translation, review, or related services.

LBTA LLC may request clarification where the source text, terminology, legal context, or instructions are unclear.

3. Legal-Linguistic Nature of the Work

LBTA LLC works to preserve meaning, legal effect, and functional equivalence within the scope of the agreed assignment. Translation and legal-linguistic review do not constitute legal advice, legal representation, or a legal opinion.

The client remains responsible for obtaining legal advice where required.

4. Certified Translations and Official Use

Where agreed in writing, LBTA LLC may provide or arrange for certified translations, translator certifications, notarized certifications, or translations prepared for official use, including German beglaubigte/beeidigte Übersetzungen, where available and appropriate for the intended purpose.

The form of certification required may vary depending on the country, authority, court, university, agency, employer, or other recipient. The client is responsible for confirming in advance whether the recipient requires a specific form of certification, notarization, apostille, legalization, sworn translation, court-authorized translation, or other formal requirement.

LBTA LLC is not responsible if a recipient rejects a translation because the client did not disclose the recipient’s specific certification, filing, formatting, or procedural requirements before the project began.

Additional certification, notarization, courier, mailing, apostille, legalization, or official-use requirements may involve additional fees and processing time.

5. Human Translator Control

LBTA LLC may use research tools, terminology tools, translation technology, or AI-assisted tools as part of its internal workflow. Final decisions, revisions, and deliverables remain subject to human translator control.

6. Fees and Payment

Fees are stated in the quote, estimate, or written project confirmation.

Payment is due on receipt of invoice.

LBTA LLC may require advance payment, partial payment, or payment before delivery for new clients, urgent projects, certified translations, official-use translations, or large assignments.

If the client requests that an invoice be paid by the client’s customer, affiliate, representative, insurer, law firm, agency, or other third party, payment remains due on receipt of invoice. The client is responsible for ensuring timely payment in accordance with these Terms and Conditions.

Additional work caused by changed instructions, incomplete materials, revised source documents, certification requirements, formatting complexity, or expanded scope may be billed separately.

7. Delivery

LBTA LLC will make reasonable efforts to meet agreed deadlines. Delivery dates depend on timely receipt of complete source materials, instructions, and any requested clarifications.

8. Review and Corrections

The client should review the deliverable promptly after receipt. Any requested corrections must be submitted in writing and identify the issue with reasonable specificity.

LBTA LLC will correct confirmed errors within the agreed scope of work. Changes in preference, changed instructions, revised source documents, certification requirements, official-use requirements, or additional formatting requests may be treated as additional work.

9. Confidentiality

LBTA LLC treats client documents and project-related information as confidential. This obligation does not apply to information that is publicly available, already known, independently developed, or required to be disclosed by law.

10. Client Responsibility for Use

The client is responsible for reviewing the deliverable before signing, filing, publishing, submitting, circulating, or relying on it in a legal, commercial, official, academic, immigration, or administrative context.

LBTA LLC is not responsible for errors or consequences arising from incomplete, inaccurate, unclear, inconsistent, or legally defective source materials or instructions.

11. Limitation of Liability

To the fullest extent permitted by law, LBTA LLC’s liability is limited to the amount paid for the specific service giving rise to the claim. LBTA LLC is not liable for indirect, incidental, consequential, special, or punitive damages.

12. Cancellation

If the client cancels a project after work has begun, LBTA LLC may invoice for work performed, time reserved, project preparation, certification preparation, and any non-cancellable costs.

13. Intellectual Property

Upon full payment, the client receives the agreed deliverable for the intended use. LBTA LLC retains all rights in its internal methods, templates, terminology processes, workflows, know-how, and quality-control materials.

Analyse des Übersetzungsfehlers:
Fehlinterpretation typischer Vertragsformulierungen

Fehlerart: Unangemessene Übersetzung von vertraglichen Ausnahmeklauseln

Ausgangsbeispiel: „Any transfer of Shares in the Company by a Co-Investor is, except for the provisions of Clause x.x“,
